‘Mathe wa Ngara’ says she has never been summoned opposes her warrant of arrest

Famous ‘Mathe Wa Ngara’ has opposed the application seeking for her arrest saying she has never been summoned.

Nancy Kigunzu now known as Mathe Wa Ngara has asked court not to issue the warrant of arrest being asked for by police arguing that it’s illegal.

Through her lawyers Danstan Omari and Cliff Ombeta, Kigunzu says police have not summoned her to appear at the police station.

“The state’s request to seek warrants of arrest is inimical to the rights of a suspect under article 49 as read together with article 50 of the Constitution as the investigating officer in this matter has not demonstrated the difficulty in summoning the suspect and thus the request for warrants of arrest is in itself premature and uncalled for,” reads court papers.

The police has filed an application at the JKIA court seeking for warrant of arrests against Kigunzu saying she is on the run.

Omari has also filed a separate response opposing the application to detain Kigunzu sons for a further five days.

He argues that the two boys should be released as they are minors and their rights have been violated by being detained in the same cell as adults.
