A Somali man who police claim is the mastermind of the Garissa attack has been released on bail by a Nairobi court
Abdi Yusuf who was charged with terrorism related is alleged to have been one of the masterminds of the attack and the prosecution has opposed his release.
In her ruling, Magistrate Agnes Mwangi while releasing him on bail said the allegations of being a mastermind had not been proved.
“It will be unfair for a court to act on such information who is entitled to be presumed innocent till found guilty. I find no merit in that argument,” the court ruled
Abdi has also been charged with obtaining a National Id card by pretending he was the son of Ralia Mohammed Wardere alias Iron Lady a fact he knew to be false.
Mwangi further ruled that the claim that Abdi is a Somali had not been proved adding that it still remains to be an allegation.
Abdi was also charged with another count of forging the said ID card and being in the country illegally.
He also pleaded not guilty to another count of uttering the said ID card and presenting it as genuine.
The prosecution had claimed that Abdi used an identification card belonging to one Abdi Yusuf Ali a brother to Abdi rahman kulow who is alleged to be the mastermind of the Garissa university attack and that the said Abdi was killed While heading the militia on Somalia.
Abdi also has another pending case of obtaining over Sh 5 million from a city businessman.
It is alleged that he falsely pretended that he was in apoition to iomport assorted cosmnetics ,Nutella , Chocolates and aptamill from Europe a fact he knew to be false.
He was released on a Sh 2 million cash bail and case will be mentioned on October 22 for pre trial.
