Keroka town residents will now know how they money collected from them by Kisii and Nyamira county governments over the last ten years has been utilised.
In the case, the court ruled on the disputed town saying each county should stick to their side as per ealier agreement and they should not collect revenue twice from the same person.
Justice Mugo Kamau has ordered the two counties to male public the utilisation of the funds collected since 2013.
“For accountabilities sake, a mandatory order be and is hereby issued compelling the respective county governments of Nyamira and Kisii to give an account to their respective county assemblies on how they have utilised the money held in the joint account they opened for revenue collections since the year 2013,” the court ruled.
The judge said this exercise shall be conducted within the next 90 days from the date of his judgment and the report shall be made public.
The court further ruled that should any party feel that the service delivery agreement entered into between Kisii and Nyamira counties in respect to Keroka town in May 21 2014 is not working, they should seek mediation
“Such a dispute should be first referred to mediation, arbitration or resolution under the intergovernmental relations act,” the court ruled.
