A truck who pleaded guilty to causing the death of a retired senior city hall official in a road accident has been jailed for nine months.
John Njuguna pleaded guilty and was sentenced to nine months in jail or pay an alternative fine of Sh 50,000.
Njuguna pleaded guilty to the charge of causing death by careless driving.
It was alleged that on October 12 2023 at 1400 hours along Southern Bypass near Kibera he caused the death of George Muchiri.
“Yes I admit the offence, my car lost control, veered off from my lane and caused the accident, I plead with the court to forgive me,” he told Kibera Senior Principal Magistrate Charles Mwaniki.
According to the prosecution, the accident involved motor vehicle registration number KDE209/ZG9169 M/BENZ Actros which was being driven by Njuguna and KAT 106N Mitsubishi pick up which was being driven by the deceased.
According to the covering report, Njuguna who was driving from Kikuyu directions towards Mombasa road with an Empty trailer that had veered of the road to the right, lost control and jumped over the road kerb separating the median section of the the dual carriage from Mombasa road heading towards Kikuyu direction, it hit Muchiri’s car and he died on the spot.
The magistrate directed that the accused person pay a fine of Sh50,000 or serve a jail term of nine months.
“The court has noted that the accused person has pleaded guilty to the charges and has also saved the judiciary time in handling his case, I have considered his mitigation and is hereby sentenced to nine months in jail or serve a jail term of nine months, he can appeal with 14 days if he wishes to do so,” the court ruled.
