The Political Parties Disputes Tribunal will deliver its decision on March 26, 2026 in a case filed by Nairobi Senator Edwin Sifuna challenging a move by the Orange Democratic Movement (ODM) to remove him as the party’s Secretary General.
The dispute arose after ODM’s National Executive Council (NEC) resolved earlier this year to oust Sifuna from the influential position, accusing him of indiscipline and violating party protocols.
Sifuna moved to the tribunal contesting the decision, arguing that the NEC failed to follow the procedures set out in the party’s constitution and the Political Parties Act before announcing his removal.
Through his legal team, Sifuna maintains that the process used by the party leadership was irregular and denied him a fair opportunity to respond to the allegations.
During the hearing of the case, lawyers representing ODM argued that the senator rushed to the tribunal prematurely and should have first pursued the party’s internal dispute resolution mechanisms.
They maintained that the party’s structures provide adequate avenues for resolving internal disagreements before members seek intervention from external bodies.
Sifuna’s legal team, however, told the tribunal that the NEC’s decision was procedurally flawed and inconsistent with democratic principles within political parties.
They argued that the process used to remove him did not comply with the requirements of the party constitution and the law governing political parties.
Earlier in the proceedings, the tribunal issued conservatory orders temporarily stopping ODM from implementing the resolution to remove Sifuna.
The tribunal also barred the Registrar of Political Parties from publishing the NEC decision in the Kenya Gazette pending the determination of the case.
Those interim orders effectively allowed Sifuna to remain in office while the tribunal heard the dispute to completion.
The tribunal is now expected to determine whether the NEC acted within the law and the party’s internal rules when it moved to remove the Secretary General.
