The Kenya Sports Tribunal has overturned the decision made by the Cricket Board of Kenya in August 2024 to suspend Kalpesh Solanki from his role as treasurer.
In a ruling delivered by Tribunal Chair Hon. Elynah Sifuna, the tribunal found that Solanki’s suspension on August 29, 2024, was unlawful and reinstated him to his position. The tribunal determined that the board had breached Solanki’s constitutional right to a fair hearing under Article 50 by suspending him without granting him an opportunity to defend himself.
Solanki, represented by Advocate Danstan Omari’s law firm, challenged the board’s decision in court. He argued that his suspension was not only unjust but posed a risk of irreparable harm, especially if the board proceeded with discussions about his removal during the upcoming Annual General Meeting (AGM).
Following his petition, the High Court intervened, halting the election of Cricket Kenya officials and barring the board from holding any AGMs, related meetings, or pursuing disciplinary action against Solanki until the matter was resolved.
