Showdown in court as Brian Mwenda’s Lawyers Omari and Khaminwa take on LSK president and council members.

There was a showdown in court on Wednesday afternoon as alleged fake lawyer Brian Mwenda’s lawyers John Khaminwa and Danstan Omari took their LSK president Eric Theuri head on.

Mwenda was charged with six counts which included forging and uttering his certificate of admission and practicing certificate.

However, Omari took issue with Theuri and other council members representing LSK as victims in the case saying they should not be admitted as advocates watching brief.

Omari told Chief Magistrate Lucas Onyina that Theuri and the other members were likely to be witnesses in the matter and it would be prejudicial for Mwenda if they are allowed.

Omari further submitted that after investigations some LSK staff maybe accused persons in the case so they cannot be victims lawyers.

He further said that as it was now LSK was a crime scene and so Theuri and team cannot come to court to represent the society.

He told court that LSK could only hire lawyers but not represent themselves.

Omari also brought the issue of LSK politics saying it was campaign time for the next elections in February that’s why the issue was before court.

On his part, Khaminwa said it was laughable that LSK was calling themselves victims arguing that in law they are definitely not victims.

Mwenda had a battalion of lawyers representing him led by Khaminwa and Omari.

Others included Shadrack Wambui, Michelle Omwoyo,Shanice Maingi,Dorcas Mwae, Sophie Nekesa and Lisa Wanjiru.

In response Theuri said they are allowed in law to represent the society as victims in the case.

The court will deliver ruling for the application on Thursday afternoon.
