Assistant Deputy Director in the Lands Administration Office was on Friday arraigned before a Milimani court and charged with land fraud.
It was alleged that Andrew Aseri Kirungu conspired with others not before court to defraud two men a parcel of land located at lower Kabete valued at Sh 1.35 billion.
According to the chargesheet, Kirungu and Davis Nathan Chelogoi who is still at large conspired to defraud Ashok Rupshi and Hitenkumar Amritlal Raja the said land measuring 7.39 Hectares situated along Lower Kabete Road valued at Ksh 1,350,000,000.
Andrew was further charged with fraudulently obtaining a Land registration number.
The prosecution alleged that on diverse dates between May 2020 and June 2021, Andrew and Chelogoi while at the State Department of Lands and Physical Planning in Nairobi, with intent to defraud, procured registration of the said land by falsely pretending the land belonged to Chelogoi.
He was further charged with abuse of office and I was alleged that on diverse dates between December 2020 and May 2021 at the State Department of Lands and Physical Planning in Nairobi, being a person employed in the Public service as an Assistant Deputy Director in the Lands Administration Officer, for the purpose of gain, fraudulently made certificate of Title L.R No. 18485I.R. No. 232908 in abuse of the authority of his office which was prejudicial to the alleged legal owners of the said land.
Kirungu denied the charges before Principal Magistrate Dolphina Alego and pleaded with the court to release him on reasonable terms.
He will remain in custody until Thursday next week when the court will rule on bail and bond.
The court has also issued a warrant of arrest against Kirungu accomplice Chelogoi after the prosecution said he might have escaped to Uganda to evade justice
