Mother whose only son’s genitals were crushed by 5 teachers wails in court as she recounts ordeal.

A mother whose only child’s genitals were crushed by five teachers while being punished in school brought a Kakamaega court to a standstill as she wailed uncontrollably while testifying.

 

In the case, Adelaide Athaka Majoni, Vincent Kadasia Mbakaya, Argedius Lubembe, Victor Andove Achesa and Eglay Lungatso Lilungu have been charged with assaulting the pupil a minor.

The boy was subjected to corporal punishment by the teachers after he was reportedly found in possession of a mobile phone while in school on October 19, 2021.

An emotional Caroline Khamali was overwhelmed by emotions when she took the dock, she could not control her emotions leading the court to suspend her testimony and stand her down.

 

Trouble started when the defence lawyers started to cross-examine her and brought out letters which she said were fake leading her to lose her cool and start wailing in court.

The Lawyers claimed that the letters which had Khamali’s signature included an apology from her son who repented to his teacher and mother for stealing three phones and selling to another pupil at 500.

They further claimed that one of the letters had Khamali’s signature allegedly bounding her not to proceed with the assault case beyond her son’s school gate.

A now agitated and angry Khamali strongly denied the claims and told court that she was being intimidated by the same people who hurt her son.

“I don’t know the letters, I did not append my signature on such, you can’t hurt my child and box me further by these fake letters,” she said

That’s when things took a downhill turn and Khamali lost her cool and started wailing and shouting in court.

“Alikuwa amefanya nini mtoto wa miaka kumi na mbili, kwanini mwanaume mmoja hange discipline mtoto badala ya wanaume watatu na wanawake wawili,” she yelled in court

“Afadhali wangeniua mimi, mtoto wa miaka kumi na mbili pekee, mungeniua mimi nimebaki tu na huyo mmoja,” she wailed.

Khamali also a teacher but at a different school wailed uncontrollably questioning why she was being harassed by the accused lawyers to answer to lies made up by them.

Senior Resident Magistrate Viena Amboko stood the mother down and cautioned the defence lawyers to be more empathetic saying they provoked her to the point of making her too emotional as she remembered her child’s injuries.

“Because of that I feel that we adjourn the hearing to September 22, 2023 when I believe she would be of sober of mind to give her side of the story. The prosecution should as well bring the schoolmates of the injured child to testify.” court ruled.
