Kenya Magistrates and Judges Association(KMJA) through Lawyer Danstan Omari has called for immediate arrest and prosecution of Mumias MP Peter Salasya for threatening a Kakamega magistrate.
In a letter to the DPP, Omari says KMJA wants Salasya arrested for threatening Magistrate Gladys Kiamah for ruling that he pays Sh 500,000 that he owed a businessman.
Omari further says that Salasya has gone ahead to boast publicly that no one can arrest him and that nothing can be done to him.
“The same is interpreted by our clients to be a mockery of our security and justice organs in the country and portrays the said national institutions as weak and incapable of enforcing the law,” Omari says.
He further says that the association is taking the threats against their member very seriously.
“This is not the first time a judicial officer is threatened after carrying out their constitutional mandate. Some have been grievously harmed while others have even been killed after performing their work diligently,” the letter reads.
He says that they believe that failure to arrest the MP and have him immediately arraigned in court over the threats shall amount to discrimination under Article 27 of the constitution as members of the public who have abused and threatened individuals within the Republic of Kenya have been arrested and arraigned in various courts throughout the country.
While addressing the media at Milimani Law Courts, Omari and KMJA President Derrick urged the DPP to take action against the MP saying he is not above the law
