Kirinyanga county Assembly Clerk denies disobeying order barring them from sitting to discuss MCA Mathenge’s inciting remarks.

The clerk of the Kirinyaga County Assembly Kamau Aidi has denied disobeying court order barring them from sitting to discuss MCA David Mathenge’s inciting remarks he made in March,

Kamau told court that they were not aware that there was a court order when the powers and privileges committee sat to discuss MCA Mathenge.

The high court in Kerugoya had issued orders barring the committee from sitting to discuss Mathenge’s issue for three days and ordered the assembly to be served.

Lawyer Danstan Omari for Mathenge told to court that they had indeed served the county assembly online and even effected a physical service that morning but they still went ahead to sit.

However, in their defence Kamau has told court that they were not aware of the orders until later when they sitting had already kicked off and witnesses testified.

Kamau said the order had been served via his email and WhatsApp which he doesn’t access often that’s why he didn’t see the order.

“The orders were received by the office of the clerk at 10.a.m. it was only then that I learnt that Mathenge had attempted service upon myself via WhatsApp platform and my personal email address that I rarely access,” reads court documents.

Kamau says he is aware that the committee commenced hearing last week and testimonies of witnesses were taken ad proceedings were ongoing before receipt of the order.

But, Kamau says the decision regarding the outcome of the hearing against Mathenge has not been rendered yet.

In the case, Mathenge through lawyer Dasntan Omari has challenged the decision by the committee to summons him saying it’s all settling political scores.

Mathenge was summoned to appear before Committee for purportedly issuing false utterances, inciteful and misleading information and also demonstrated disrespect to members of the County Assembly.

Omari had argued that his client would have suffered irreparable harm and lose out on the international trip for today October 10 as he is likely to be suspended from the Assembly and therefore the people of Baragwi Ward will not be able to have any representative in the assembly for a while.
