Kimwarer Arror Dams case adjourned

The hearing of the Multi-billion Kimwarer Arror dams graft case was adjourned after a witness told court that he was not in the right frame of mind to testify.

Gideon Rotich who was scheduled for cross-examination by the defence came to court late and apologised saying he was dealing with a personal issue.

“Your honour I am very sorry for coming late to court I was dealing with a personal issue late into the night and even early this morning that’s why I I am late. I am requesting for time to rest before I testify” Rotich told court.

The prosecution told trial magistrate Eunice Nyutu that their witness would have testified but because of his personal issue he was not ready to that.

The defence lawyers said they were not opposed to an adjournment due to the reasons given by Rotich they would indulge him.

The hearing was adjourned to Tuesday August 1 when Rotich will take the stand for cross-examination by the defense.

Interestingly, in September last year Rotich had refused to testify in the claiming that he was not no longer working for NEMA thus had no access to the document saying he needed time.

The court adjourned the matter and gave him time to access the documents and in November he testified.

In his evidence in chief, Rotich a former NEMA official had testified that the environmental authority had followed all due process in issuing licenses for construction of the two dams.

Rotich said they issued two separate licenses for the construction of the Kimwarer and Arror Dams to the Kerio Valley Development Authority.

He showed court a license dated April 4, 2018 for the Kimwarer Multipuprose issued to KVDA and it was the one to undertake the construction of the dam.

In the case, former Treasury CS Henry Rotich has been charged alongside six others with conspiracy to defraud Sh63 billion in the Arror and Kimwarer dams case.
