Former Deputy President Rigathi Gachagua has told court that he does not want to be reinstated back to his position as DP as he had earlier prayed in his case.
Through Lawyer Paul Muite, Gachagua has however said he is more interested in being awarded damages for his illegal impeachment and also being granted all benefits he was to get in his five year term.
Muite said he had instructions from his client to seek for leave to ammend his petition to reflect the new directions.
Gachagua will be pursuing compensation equivalent to what he would have earned had he served the full five-year term.
Gachagua says he no longer wishes to continue with the case as originally filed and will not be seeking any declaration to be reinstated.
Muite says Gachagua focus is now on challenging the legality of the impeachment and pursuing damages accordingly.
Gachagua will not file any intercullotory application adding that he wants the earliest dates for the hearing.
“His petition is not a public interest,it’s his petition affecting him direct ,he is the one who was impeached,”Muite said
All the respondents in the case did not object to Gachagua application to amend the petition.
