Ex-DP Gachagua and his business partner Muthoni Accused of Illegal Occupation of 25 M Apartment

Deputy President Rigathi Gachagua and Julia Muthoni Mwangi are facing accusations of illegally occupying an apartment in Nairobi without fulfilling the agreed purchase conditions.

A demand letter dated September 30 2025 from Adrian Kamotho Njenga & Company Advocates, acting on behalf of Royal Importers and Exporters Limited, alleges that the two gained access to Unit 02 on the first floor of Block D at Skyrock Apartments, erected on L.R. No. 330/317, without paying the agreed purchase price of twenty-five million shillings.

According to the law firm, the agreement required that the full purchase price be paid prior to taking possession of the property, but despite this clear undertaking, the two have remained in occupation.

The letter notes that the client has been patient, expecting that Gachagua and Mwangi would honor their obligations and respect property law, but instead they are accused of deliberately taking the property owner for a ride.

The demand letter instructs Gachagua and Mwangi to immediately deliver vacant possession of the property and to unconditionally admit liability for unlawful occupation, including settlement of all attendant sums to be calculated according to prevailing market indices.

It further warns that unless these demands are complied with, the advocates are under strict instructions to take lawful action to protect their client’s interests, which could include auctioning items placed in the premises.

Signed by Dr. Adrian Kamotho, PhD, the letter stresses that any measures taken to enforce the instructions will be at the occupants’ own peril, exposing them to legal costs and other consequences.

The dispute adds to the growing list of high-profile property battles in Nairobi, underscoring the intensity of legal enforcement in the city’s real estate sector.
