The Ethics and Anti-Corruption Commission(EACC) has opposed the release of Sh 2 M that was seized at Thika Chief Magistrate Stella Atambo’s home back to her husband as had been prayed for.
In the application, Atambo’s husband Evans Achoki had asked court to release the money to him saying it’s his money and not his wife’s.
However, the commission says Achoki has not shown how he acquired the money and what businesses he conducted if any to warrant the court to release the money to him.
Further, it says that the prayer for the release of the money is in his wife’s petition and it says that the money and any other item seized at her home be returned back to her.
The commission has asked the court to dismiss the application by Achoki to be enjoined in the case against Atambo saying he is not acting in good faith.
“He does not have an identifiable or recognizable stake or interest in these proceedings and will not be affected by the decision of the Court when it is made, either way,” reads court documents.
According to court papers, Achoki will not suffer prejudice if he is not joined to the proceedings and has not demonstrated that his interest will not be well articulated unless they appear in the proceedings.
