The Director of Criminal Investigations (DCI) has been ordered to submit a report to the court regarding the progress of the investigation into the alleged abduction of Dela Ward MCA Yusuf Hussein Ahmed by October 4, 2024.
Justice Alexander Muteti emphasized the urgency of the matter, stating, “When the liberty of an individual is involved, nothing can be more urgent than that.” He highlighted the critical need for the state to recognize the importance of timely responses in such cases.
In addition to the investigation report, the judge instructed the DCI to ensure the safety of a key witness, Wambua Kioko, who reported the abduction. Justice Muteti called for a formal application to place the witness under protection, underscoring the potential risks faced by individuals involved in such serious cases. “It is important for everybody to realize the urgency of the matter,” he said. “These people look at you to provide answers they cannot obtain on their own.”
MCA Yusuf Hussein Ahmed was reportedly abducted on the night of September 13, 2024, from a taxi while returning home from South B estate. The Law Society of Kenya (LSK) lawyers, along with Advocate Danstan Omari and Shadrack Wambui, representing the family in court, have urged the judiciary to act decisively to protect the MCA’s liberty.
SSP Jastus Imana, the Deputy Regional Criminal Investigations Officer for the Nairobi region, confirmed in court that the MCA is not in police custody. He acknowledged that a report regarding the abduction was filed by the driver of a Faras taxi, whom the MCA had hired to take him home.
The court has set the next hearing for October 4, 2024, to review the DCI’s findings and determine the subsequent steps in the case.
