Court Declines to Release Passport of IT Expert Ndiangui

A Nairobi court has declined to release the passport of IT expert and social media commentator Ndiang’ui Kinyagia, who is under active investigation over undisclosed offences.

The court heard that documents seized from Kinyagia, including his passport and yellow fever card, are part of ongoing investigations, with the Office of the Director of Public Prosecutions (ODPP) considering possible charges against him.

Prosecutors opposed the request for the release of the travel documents, arguing that doing so could jeopardize the integrity of the probe.
I am inclined to object to the release of the documents as it will compromise the ongoing investigation,” the state counsel told the court.

Kinyagia, through his lawyer, pleaded with the court to release the passport, saying he needed to accompany his sister to India for urgent medical treatment.
He does not know why his passport and yellow fever card are being held. No reasons have been given by the respondents. Health does not wait the travel to India is an emergency,” his lawyer told the court.

The court, however, declined to issue interim orders and directed Kinyagia to file written submissions. The matter will be mentioned on January 15 for ruling.
