Blow to Government as Court Stops Gazettement and Swearing in of IEBC Nominees.

The government has suffered a major blow after high court on Thursday barred the government from gazetting or swearing in the seven IEBC nominees pending hearing and determination of the petition challenging the process.

Justice Lawrence Mugambi issued conservatory orders stopping the gazettment of the IEBC nominees.

The seven include Erastus Edung Ethekon who was nominated as the next IEBC chairperson, and commissioners Anne Nderitu, Moses Mukwana, Mary Karen Sorobit, Hassan Noor, Francis Odhiambo, and Fahima Abdalla.

However, Justice Mugambi allowed parliament to continue the vetting process but the nominees should not be gazetted until the case is determined.

The court has further forwarded to the file to the chief justice for empnallment of a bench that will hear and determine the issues raised inthe petition .

Justice Mugambi noted that the issues raised in the petition touch on the sovereignty of the people thus he was persuaded to issue the conservatory order.

He also said that the case has raised serious questions of law that the court can’t wave off and needs interrogations.
