15 police officers majority attached to the disbanded SSU secured a big win on Friday after the high court ordered the DPP to drop the abduction case against them.
The accused had been charged with abduction before the Kahawa Law courts but the DPP later charged them with a different charge of murder for the same offense.
Through their lawyers led by Danstan Omari, Wandugi Kirathe and Steve Ogolla, the officers had challenged the decision arguing that it was double prosecution for the same offense related to the same victims.
Justice Abigael Mshila directed the DPP to either withdraw the matter under section 87 A or enter a nole prosecui for it within the next 21 days.
This means that the only matter remaining in court against the accused is the offense of murder before the high court.
The 15 were charged with abducting two Indian Nationals and a taxi driver in 2022 just before the General elections.
