Advocate Ordered to Produce Medical Report After Missing Court in Gold Fraud Case

Advocate Alphonce Collins Odoyo Osewe has been directed to present a medical report to the court to prove that he was indeed unwell, after failing to appear in court to face charges of obtaining money by false pretences.

Osewe was scheduled to be arraigned alongside his co-accused, Patroba Odhiambo Tobias, but only Patroba appeared when the matter was called.

According to the charge sheet seen by Court Helicopter News, Osewe and Patroba are accused of defrauding Bernard Shlaundu of USD 260,400 (approximately KSh 35,737,296) between May 1 and May 9, 2023, in Nairobi County. The two allegedly obtained the money under the false pretense that they could sell him 400 kilograms of gold bars.

Separately, Osewe is expected to face another charge of obtaining KSh 26.1 million from Adeye Enitan by falsely claiming he could also sell him 400 kilograms of gold.

Both suspects are further charged with acquiring proceeds of crime amounting to KSh 35,737,296, while Osewe faces an additional count for allegedly acquiring KSh 26.1 million knowing it was derived from criminal activity.

Patroba, who appeared before Chief Magistrate Lucas Onyina, denied the charges. He was ordered detained at Capitol Hill Police Station until October 24, 2025, pending the filing of an affidavit by the investigating officer opposing his release on bond.
