The case was coming up on Monday for hearing but the court was informed that Obiero was not present due to his bereavement.
Obiero lawyer told court that Obiero lost his wife and children in a road accident in March and the family is yet to bury the deceased.
He said his client was unable to attend proceedings and urged the court to give him time to allow him go on with the funerals arrangements.
“The accident happened in March and the reason as to why they are burying the two people in May is because of finances issues and also the Luo culture which have pre and post rituals to be performed especially when you lose a wife,” he added
The judge conveyed her sympathy to Obiero and adjourned the matter to May 6 when the family would have been buried.
The prosecution told the court that they have at least four witnesses to testify in the case who include the investigating officers.
