The High Court has quashed the 109-year jail sentence that had been handed to Stephen Nzuki Mutisya, a former director of a Nairobi children’s home, who had been convicted of defiling four minors under his care.
Nzuki had been found guilty by Principal Magistrate Zainab Abdul, who ruled that the prosecution had proved its case beyond reasonable doubt, leading to his conviction and an unusually lengthy custodial sentence.
During trial, the court heard that Nzuki would allegedly invoke Bible verses to justify his acts to the minors, convincing them that his conduct was acceptable.
However, on appeal, the High Court found that the conviction was unsafe and the evidence presented before the trial court did not meet the legal threshold required to sustain the guilty verdict.
Consequently, the High Court set aside both the conviction and the sentence, ordering Nzuki’s immediate release unless held for any other lawful reason.
