Nairobi Doctor Fined Ksh 200,000 for Causing Death by Dangerous Driving

A Nairobi-based medical doctor has been fined Ksh 200,000 after being convicted of causing death by dangerous driving in a fatal accident that occurred in Ngara.

Dr. Moses Njoroge Ndung’u was on Thursday convicted by Milimani Principal Magistrate Geoffrey Osarigo for fatally knocking down pedestrian Kijendi Kithome near the Fig Tree area.

The court was told that CCTV footage captured Dr. Njoroge speeding towards Kasarani before his vehicle veered off the road and struck Kithome, who was walking on the sidewalk.

Although the doctor administered first aid at the scene and rushed the victim to Kenyatta National Hospital in a taxi, Kithome later died from severe head fractures sustained in the crash. A postmortem report presented in court confirmed the injuries as the cause of death.

In his defence, Dr. Njoroge claimed he had swerved to avoid hitting a matatu. However, the magistrate rejected this explanation, pointing out that CCTV footage showed the matatu had already stopped to give way.

Having analyzed the evidence, particularly the CCTV footage, I find the accused guilty under Section 215 of the Criminal Procedure Code for the offence of causing death by dangerous driving,” ruled Magistrate Osarigo.
