Man Charged with Forcible Detainer of Land in Loresho

Martin Kipngania Komoi has been charged with forcibly detaining a parcel of land in Loresho, contrary to Section 91 of the Penal Code.

Komoi, who appeared tense and visibly shaken as he faced the court, denied the allegations leveled against him by the prosecution. He maintained his innocence, stating that he did not unlawfully occupy the disputed property.

The prosecution claims that Komoi unlawfully took possession of the land, which belongs to Ashok Kumar Rupshi Shah and Hitenkumar Amritlal Raja, and continued to occupy it without legal justification. His actions were allegedly conducted in a manner likely to cause a breach of the peace.

Additionally, the prosecution alleges that Komoi trespassed onto the property with the intent to commit a felony.

Komoi appeared before Chief Magistrate Lucas Onyina at the Milimani Law Courts, where he pleaded not guilty. The court granted him release on a cash bail of Ksh 50,000.
