A Mombasa court has issued a warrant of arrest against Police Corporal Moses Mahiuha, the investigating officer in the 2019 Likoni Ferry tragedy, over claims of mishandling crucial CCTV footage.
Chief Magistrate Alex Ithuku gave the orders after the officer failed to appear in court to explain how he returned the footage to Kenya Ferry Services without maintaining a proper chain of custody.
The footage is believed to contain key evidence in the inquest probing the deaths of Mariam Kighenda and her 4-year-old daughter Amanda Mutheu, who died after their car plunged into the Indian Ocean on September 29, 2019.
“The investigating officer must comply with court summons. No excuses will be accepted if he fails to appear,” Magistrate Ithuku ruled, terming the absence as obstructive to the search for justice.
The court’s directive followed an application by state counsel Alex Ndiema, who is leading the inquest.
The matter will be mentioned again on August 4, 2025, for further hearing.
